Maori Council confirms appeal on water case

The Maori Council has filed an appeal against this week’s High Court dismissal of its legal bid to delay the sale of Mighty River Power shares.
Maori Council lawyer Felix Geiringer last night confirmed on Twitter that court papers had been filed yesterday.
Mr Geiringer indicated that the council had filed papers with the Court of Appeal but the Crown had asked for the case to go directly to the Supreme Court.
If the Supreme Court refuses to hear the case it would go to the Court of Appeal on January 31, he said.
The Government intends selling up to 49 per cent of Mighty River some time between March and June in the opening move of its partial asset sales or “mixed ownership model” programme which it hopes will raise as much as $7 billion.
Treasury Deputy Secretary John Crawford has said all appeals challenging the sale would have to be completed by February 18 in order to meet the Government’s preferred timetable or by March 11 to have any chance of selling Mighty River shares before the end of June.
Any delay would create a big hole in the Government’s expected revenues and result in increased debt.
In a judgement released early this week the High Court’s Justice Ronald Young comprehensively dismissed arguments from the Maori Council and the Waikato River and Dams Claims Trust that the sale would affect the Crown’s ability to provide redress for Maori claims to a proprietary interest in fresh water and geothermal resources.

It will be interesting to repeat the same Pakeha NO CAN DO MAORI PROCESS through the British Courts System as per usual using their cleverly constructed laws and legal arguments skewered towards a predetermined outcome which the likes of Key and Judith Collins and many a legal eagle gone before has engineered to the detriment of Maori. Regardless of the outcome the government as per usual will promptly depending on terms rightly or wrongly change the law’s again to suit their monetary agenda. Thus I am constantly bemused and wonder when oh when will Maori learn that the dermally challenged that reside in our midst will never allow us Maori equal status with them under their law in this land or for any other reason. One only has to look at their treatment of other indigenous nations the world over to see the outcome of such petty legal pleadings buy suitors of similar actions. Zero. Empty bank account usually. One does then have to ask how many more billions of Maori money should we collectively continue to spend by pouring it down the drain on such vain legal jousts? How much more are we as a Sovereign Peoples in our OWN RIGHT in OUR OWN COUNTRY going to allow of this crap. If one reads the Herald Today one should take the time to read Brain Gaynors article in the business section as it highlights as to who actually owns the debt these water asset are being sold off to repay. One will note most of the major companies we might have thought we owned we actually do not and the bill we are collectively being asked to pay via the sale of state assets is certainly not Kiwi or Maori’s overseas debts but those of some foriegn corporate entity. You will also note this doesn’t include the Aussie banks etc. So how much is actually being bled out of our country annually by foriegn corporates, who are also pushing up the price of land and Maori Multiple Owned land rates. Adding another straw to the Maori Camels back. Thus why should Maori again be forced to trust the government to honour any agreement over water or pre-existng agreements like the CNI and ETS when few such deals have been honoured throughout the history of this country. Had it been so we today would not have a 98% percent ownership of near all land by Pakeha and we Maori some left with a puny 2% if lucky at that. Readers are reminded that we Maori are at a critical time in history where the planet is rapidly heating up and survival of the fittest seems to be the looming paradigm and only offering available. Thus let us not be fooled by government lies any longer.
